The use of rented equipment or subcontractors does not affect the scope, price or quality standards agreed upon in your service contract. Bush Yard Co. remains the responsible party for delivering the agreed scope of work.
Your contract is with Bush Yard Co. regardless of which equipment or crews are used to complete your project.
Certain types of work in BC and Alberta require specific provincial licenses, certifications or permits — for example: septic system design and installation, plumbing, electrical, structural demolition, and others.
Bush Yard Co. does not hold all licenses required for every type of work. When a project requires licensed work that we do not hold directly, we will:
Bush Yard Co. will not perform work that legally requires a license we do not hold unless it is performed under the direct supervision and responsibility of a properly licensed party.
Bush Yard Co. maintains commercial general liability insurance and WCB coverage in all provinces where we operate. Certificates of insurance are available upon request.
The client is responsible for:
Bush Yard Co. is not liable for damage to unmarked underground infrastructure, or for costs arising from permit delays that are the responsibility of the property owner.

Bush Yard Co. operates in two distinct capacities depending on the nature of the work. The allocation of responsibility differs accordingly:
When we perform the work directly — using our own or rented equipment operated by our personnel — Bush Yard Co. takes full responsibility for the quality and completion of the work. Any disputes, deficiencies or concerns are resolved directly with us. We are committed to finding a fair solution to any problem that arises and will always engage in good faith to make it right.
When work is performed by a subcontractor — an independent operator or company engaged by Bush Yard Co. on your behalf — the subcontractor is the responsible party for the quality of their specific scope of work. In such cases, Bush Yard Co. acts as a project coordinator and intermediary. We do not assume direct liability for a subcontractor's workmanship, delays, or omissions.
However, even in subcontractor scenarios, we do not simply walk away. Our commitment is:
We understand that from a client's perspective, you hired Bush Yard Co. — not an anonymous crew. We take that relationship seriously regardless of who physically performs the work.
If you are ever unsatisfied with any aspect of your project — whether performed directly by us or through a subcontractor — please contact us first at mail@bushyard.ca before escalating. We will respond within 24 hours and work with you to resolve the issue.

Submitting a quote request through our website does not create any obligation on either party. No work will be scheduled or performed until a written agreement is signed.
Bush Yard Co. collects personal information (name, email, phone, location) only when you voluntarily submit it through our contact or quote forms. This information is used solely to:
We do not sell, rent or share your personal information with third parties for marketing purposes. Information may be shared with subcontractors engaged to perform work on your project, on a need-to-know basis only.
Photos you submit are used only for project assessment and quoting purposes. We may use before/after project photos for our own marketing materials — we will always ask your permission before doing so.
Our website does not use tracking cookies or third-party analytics beyond standard server logs. We do not run retargeting advertisements.

This section applies to all independent operators, companies and individuals who perform work on behalf of Bush Yard Co. as subcontractors ("Subcontractor").
Prior to being assigned any work, and on an ongoing basis, each Subcontractor is required to maintain and provide valid, current copies of:
⚠️ Bush Yard Co. will verify submitted documents to the best of our ability. However, the Subcontractor bears sole responsibility for ensuring that all their documentation is valid, current and legally compliant at all times — including on the day of any job.
If a Subcontractor's WCB clearance, insurance policy, license or any other required document lapses, expires or is cancelled for any reason — including non-payment of premiums — the following applies:
Bush Yard Co. performs document checks at onboarding and periodically thereafter. However, these checks do not transfer responsibility to Bush Yard Co. The obligation to maintain valid documentation rests entirely with the Subcontractor at all times.
The Subcontractor is required to promptly notify Bush Yard Co. of any changes to the following, no later than 3 business days after the change occurs:
Failure to notify Bush Yard Co. of material changes in a timely manner may result in suspension from the subcontractor network and may affect the Subcontractor's eligibility for future work assignments.
When performing work assigned by Bush Yard Co., the Subcontractor agrees to:
⚠️ This section is legally binding and applies to all subcontractors who receive client referrals or job assignments from Bush Yard Co.
The Subcontractor expressly agrees that:
Once a job is assigned, the Subcontractor works directly with the client, determines pricing for the job and any additional work, and collects payment from the client directly. Bush Yard Co. does not intervene in day-to-day client communication or payment collection.
However, the Subcontractor is required to keep Bush Yard Co. informed at all times:
In short: you work directly with the client and collect payment yourself. Just keep us informed — a quick message about any additional work and the amount is all we need. We use that to calculate and invoice our commission.
Bush Yard Co. provides client acquisition, marketing and job coordination as a paid service. The Subcontractor collects payment from the client directly, and Bush Yard Co. invoices the Subcontractor separately for the agreed commission or referral fee.
How it works in practice: You get the job from us → work directly with the client → collect payment from the client → send us a brief report of what was done and the total amount → we invoice you for our commission → you pay within 7 days. Simple, transparent, ongoing.
By submitting a subcontractor profile through our website or accepting a work assignment from Bush Yard Co., the Subcontractor acknowledges and agrees to all terms set out in this Section 9.
